These Terms & Conditions (“Terms”) govern your access to and use of nationalpain.com and any related pages, forms, or digital services (the “Site”), operated by National Pain Centers (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Eligibility & Acceptance
You must be at least 18 years old and able to form a binding contract to use the Site. By using the Site, you represent that you meet these requirements and that all information you provide is accurate. These Terms incorporate our Privacy Policy by reference.
Medical Disclaimer — No Physician-Patient Relationship
The Site is provided for general informational purposes only and does not provide medical advice, diagnosis, or treatment. Content on the Site is not a substitute for professional medical care from a qualified provider.
Your use of the Site does not create a physician-patient, provider, or other professional relationship between you and National Pain Centers or any affiliated physician, clinician, or personnel. No such relationship is formed until it is expressly established through a formal intake, evaluation, and mutual consent process. Always seek the advice of a qualified health professional with any questions regarding a medical condition, and never disregard or delay seeking care because of something you read on the Site.
No Guarantee of Outcomes
Any descriptions of treatments, procedures, programs, or results are for general information only. Individual results vary, and no particular outcome is promised or guaranteed. Testimonials, reviews, and case examples reflect individual experiences and are not representative of what any person should expect.
Appointment & Inquiry Requests
Submitting a form or request through the Site is a request only and does not confirm, schedule, or guarantee any appointment, service, availability, or acceptance as a patient. We may accept, decline, reschedule, or cancel any request at our discretion. Do not submit detailed medical or sensitive information through the Site.
License to Use the Site
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial purposes. We may suspend, restrict, modify, or terminate your access at any time, for any reason, without notice.
Intellectual Property
All content on the Site — including text, graphics, logos, images, illustrations, video, audio, design, layout, and software, together with the “National Pain Centers” name and marks — is owned by or licensed to us and is protected by intellectual property and other laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, publicly display, create derivative works from, frame, scrape, harvest, or otherwise exploit any part of the Site without our prior written consent. All rights not expressly granted are reserved.

Limitation of Liability
To the fullest extent permitted by law, in no event will National Pain Centers, its affiliates, physicians, owners, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Site, whether based in contract, tort, negligence, strict liability, or any other theory, even if advised of the possibility of such damages.
In no event will our total aggregate liability arising out of or relating to the site or these terms exceed one U.S. dollars ($1.00).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in such cases, our liability is limited to the greatest extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless National Pain Centers and its affiliates, physicians, owners, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Site, your content, your violation of these Terms, or your violation of any law or the rights of any third party.
Binding Arbitration & Class-Action Waiver
Except for claims that may be brought in small-claims court, any dispute, claim, or controversy arising out of or relating to the Site or these Terms will be resolved by final and binding individual arbitration administered by a arbitrator of our choice under its applicable rules, rather than in court. The arbitration will take place in Lake County, IL, and judgment on the award may be entered in any court of competent jurisdiction.
You and National Pain Centers agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
To the extent any claim proceeds in court rather than arbitration, you and National Pain Centers each waive any right to a jury trial.
Governing Law & Venue
These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles. Subject to Section 13, you agree that any permitted court action will be brought exclusively in the state or federal courts located in [COUNTY] County, [STATE], and you consent to their personal jurisdiction and venue.
Time Limit for Claims
To the extent permitted by law, any claim arising out of or relating to the Site or these Terms must be filed within one (1) year after the claim arose; otherwise, it is permanently barred.
Changes to the Site & These Terms
Termination
We may suspend or terminate your access to the Site at any time, with or without cause or notice. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, arbitration, and governing law — will survive.
General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be enforced to the maximum extent permitted. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them freely. Nothing in these Terms creates any third-party beneficiary rights except as expressly stated.
